Can I get a divorce if my spouse doesn't agree?+
Yes. Texas is a no-fault state — you can obtain a divorce based on "insupportability" without your spouse's consent. A court can still grant divorce after proper service and a waiting period even if your spouse refuses to participate.
How does Texas decide who gets the house?+
The marital home is typically community property if purchased during the marriage. Courts aim for a "just and right" division — not always 50/50. Factors include who has primary custody of children, each spouse's earning capacity, and fault in the breakdown.
What's the difference between conservatorship and possession in Texas?+
Texas uses "conservatorship" for decision-making rights (medical, educational, religious) and "possession" for physical time with the child. Courts generally favor Joint Managing Conservatorship where both parents share major decisions.
